TERMS & CONDITIONS – MONTY ORIGINALS

These Terms & Conditions apply to all purchases made via www.montyoriginals.com. They are aligned with Monty Originals’ Shipping Policy, Returns & Refund Policy, and applicable EU consumer law.

2. Applicability
2.1. These Terms & Conditions apply to all offers, orders, and agreements concluded via the Monty Originals webshop with consumers.
2.2. By placing an order, the customer confirms acceptance of these Terms & Conditions.
3. Offer and conclusion of contract
3.1. All offers on the website are non-binding and subject to change.
3.2. A contract is concluded once Monty Originals has confirmed the order and payment has been successfully completed.
3.3. Product images are indicative. Variations in color or appearance may occur due to screen settings and do not constitute a defect.
4. Prices and payment
4.1. All prices are stated in euros (€) and include VAT, unless stated otherwise.
4.2. Available payment methods include iDEAL, PayPal, and payment options provided by Shopify Payments.
4.3. Shipping costs are displayed during checkout before the order is finalized.
4.4. In the event of an obvious pricing error, Monty Originals reserves the right to cancel the order and refund any payments made.
5. Delivery and shipping
5.1. Orders are shipped from the Netherlands in accordance with the Shipping Policy.
5.2. Orders are generally dispatched within 1–5 business days, unless otherwise stated.
5.3. Delivery times are estimates and not legally binding.
5.4. The risk of loss or damage to products transfers to the customer at the moment the order is delivered to the provided address.
5.5. Monty Originals is not liable for delays caused by carriers, but will assist customers where reasonably possible.
6. Right of withdrawal
6.1. Consumers have the right to withdraw from the contract within 14 days from the day the order is received, without stating a reason.
6.2. To exercise the right of withdrawal, the customer must notify Monty Originals viainfo@montyoriginals.com within the withdrawal period.
6.3. Returned items must comply with the conditions described in the Return & Refund Policy, including hygiene restrictions for headwear.
6.4. Personalized or custom-made items are excluded from the right of withdrawal.
6.5. Refunds will be issued within 14 days after receipt and inspection of the return, using the original payment method.
7. Complaints and statutory warranty
7.1. Products must meet reasonable expectations of quality and usability in accordance with Dutch and EU consumer law.
7.2. Complaints must be reported as soon as possible via info@montyoriginals.com, including a clear description and photos where applicable.
7.3. If a product is defective, Monty Originals will provide an appropriate solution such as repair, replacement, or refund.
8. Retention of title
All delivered products remain the property of Monty Originals until full payment has been received.
9. Liability
9.1. Monty Originals is not liable for damage resulting from improper or unintended use of products.
9.2. Any liability is limited to the total amount paid for the relevant order, unless mandatory law provides otherwise.
10. Force majeure
Monty Originals is not liable for failure to fulfill obligations due to circumstances beyond its control, including but not limited to strikes, transport disruptions, government measures, or pandemics. In such cases, obligations may be suspended or cancelled without compensation.
11. Personal data
Personal data is processed in accordance with applicable data protection laws. Further information is available in the Privacy Policy on the website.
12. Intellectual property
All content, designs, logos, and materials of Monty Originals are protected by intellectual property rights. Any use without prior written permission is strictly prohibited.
13. Governing law and jurisdiction
These Terms & Conditions are governed by Dutch Law.
Any disputes shall be submitted to the competent court in the Netherlands, unless mandatory consumer law provides otherwise.
